These Terms of Service ("Terms") govern your use of CheckTube (the "Service") operated by Aiklik.nl ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
Our Service is available at checktube.io and checktube.nl. These Terms apply to all visitors, users, and others who access or use the Service.
Description of Service
CheckTube provides an AI-powered service that:
- Generates actionable checklists from YouTube video content
- Allows users to save and share generated checklists
- Provides interactive checklist features for tracking progress
- Offers the service temporarily free of charge
Important: The Service is currently offered for free during our beta period. We reserve the right to introduce paid features or subscription plans in the future with appropriate notice.
Acceptable Use
When using our Service, you agree to:
- Use the Service only for lawful purposes
- Respect the intellectual property rights of content creators
- Not attempt to circumvent any Service limitations
- Not use the Service for commercial purposes without permission
- Not submit content that violates YouTube's Terms of Service
- Not use automated systems or bots to access the Service
- Not attempt to reverse engineer or copy the Service
Prohibited Uses
You may not use our Service:
- For any illegal or unauthorized purpose
- To transmit harmful code or malware
- To violate any international, federal, or state regulations or laws
- To infringe upon or violate our intellectual property rights or the rights of others
- To harass, abuse, insult, harm, or discriminate
- To submit false or misleading information
- To interfere with or circumvent security features
- To scrape or harvest data from the Service
- To overload or disrupt the Service infrastructure
Intellectual Property Rights
Our Service
The Service and its original content (excluding user-generated content and YouTube videos), features, and functionality are and will remain the exclusive property of Aiklik.nl and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written consent.
YouTube Content
All YouTube video content remains the property of the respective content creators. We do not claim ownership of any YouTube videos processed through our Service. Users are responsible for ensuring they have the right to use and share content from YouTube videos.
Generated Checklists
Checklists generated through our Service are derived from YouTube content. While you may use, save, and share these checklists, the underlying content rights remain with the original video creators.
User Content
Our Service allows you to save and share checklists. You are responsible for:
- The YouTube URLs you submit for processing
- Any modifications you make to generated checklists
- Ensuring your use complies with YouTube's Terms of Service
- Respecting the rights of content creators
By saving a checklist, you grant us the right to store and display it for the purpose of providing the Service. You can delete your saved checklists at any time.
Privacy
Your use of our Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.
Disclaimers
Service Availability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee that:
- The Service will be uninterrupted or error-free
- The results obtained will be accurate or reliable
- The Service will meet your specific requirements
- Any errors in the Service will be corrected
Content Accuracy
Checklists are generated using AI technology and may contain errors or inaccuracies. We are not responsible for:
- The accuracy, completeness, or usefulness of generated checklists
- Any actions taken based on checklist content
- The availability or content of YouTube videos
- Changes to YouTube's service or policies
Third-Party Services
We use third-party services (including YouTube, OpenAI, and Supabase). We are not responsible for their availability, accuracy, or any issues arising from their use.
Limitation of Liability
To the maximum extent permitted by law, Aiklik.nl shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:
- Loss of profits, data, use, or goodwill
- Service interruptions
- Computer damage or system failure
- Substitute services costs
This applies whether based on warranty, contract, tort, or any other legal theory, and whether or not we have been informed of the possibility of such damage.
Indemnification
You agree to defend, indemnify, and hold harmless Aiklik.nl and its officers, directors, employees, and agents from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the Service.
Termination
We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason, including:
- Breach of these Terms
- Conduct harmful to other users or the Service
- At our sole discretion
Upon termination, your right to use the Service will cease immediately.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
